According to the California Courts website Local Rules page, the following California Counties have rule changes effective as of July 1st: Alameda, Butte, Contra Costa, Fresno, Kern, Kings, Lassen, Los Angeles, Madera, Mendocino, Merced, Monterey, Placer, Riverside, San Francisco, San Joaquin, San Luis Obispo, San Mateo, Santa Barbara, Santa Clara, Santa Cruz, Shasta, Siskiyou, Solano, Sonoma, Stanislaus, Ventura and Yuba. While each location changed their rules in some way, only a portion of counties made updates in a way that affected the deadlines that LawToolBox.com provides to our customers. A representative sample of counties that have updates to the deadlines in their local rules include:
- Mendocino County, where Rule 1.17(a)(3) regarding file an original after electronic filing was changed from 10 calendar days to 10 court days, and new Rules 1.16 and 1.17 address Orders to Show Cause regarding case dismissal in Civil and Family actions where there is delay in prosecution.
- Merced County, where Rule 3.6 on Settlement Conferences was amended from 5 court days to 6 court days before hearing to file form MSC-CV-051.
- Placer County, where Rule 30.1.1 was added to family law regarding Private Child Custody Recommending Counseling, where certain forms must be served and filed with the request for private counseling, the other party has 10 days to object by filing a response, and the moving party must serve the order once made within 5 days of receipt. New Rule 30.19 was also added pertaining to Requests for Emergency and Expedited Hearings for Non-DCCS Matters.
- Santa Cruz County, where Rule 2.4.04(b) addresses Informal Discovery Conferences and the deadline of 5 court days prior to the conference date to file a Joint Statement as to pending discovery issues. Rule 2.2.06 on Trial Briefs had some updates to the language of the text, although the deadline itself remains unchanged.
